Additional AEO Criteria in 2013

Attached to this News item are two new Customs Information Papers that detail changes to the AEO authorisation criteria.

The criteria relate to the professional qualifiactions of "customs" personel within an organisation applying for AEO status.

First Sale For Export Valuation - An Update

The Modernised Customs Code Implementing Provisions will have the effect of outlawing the First Sale for Export Valuation provisions (First Sale allows for any sale in a series of sales - within certain conditions - to be the basis of the customs value on which duty is paid).

At the last EU Commission Valuation Committee at which these changes were discussed, the following points were made clear:

  • The UK once again argued against the change
  • Commission changes to the text make it absolutely clear that the last sale only can be used for valuation purposes
  • The only exception are goods within a Customs Warehouse where the last sale on entry into a warehouse must be used and sales within the warehouse are effectively ignored (This is clearly an opportunity of retaining some benefits of First Sale - we will maintain a watching brief on this issue)
  • The Commission beleives they have persuaded two trade bodies that the change will not be as bad as first envisaged.


EU Consultation-VAT Accounting Under Centralised Clearance

The EU Commission has today announced a consultation exercise in respect of VAT Accounting under Centralised Clearance.

Currently, importers using SASP (the current version of Centralised Clearance) can account for duty in the authorising Member State, but must account for import VAT in the country the goods are actually cleared into.

The consultation is looking at how business would want this process simplified.

Certificate of Airworthiness Relief

The attached CIP details where information about the Certificate of Airworthiness duty relief can be found, now that the relevant public notice has been withdrawn.

The C of A relief forms part of the Ricardo Aerospace and Defence Module.
